Can Notarization be Done at the Chinese Embassy in Singapore?
May not. According to the principles of authenticity and legality established in the Notarization Law of the People's Republic of China, and in accordance with the relevant spirit of the "Five Prohibitions" on Notarization Practice issued by the Ministry of Justice on August 14, 2017, the Chinese Embassy in Singapore will no longer handle notarization related to real estate or other major assets, or notarization related to corporate affairs such as equity transactions, loans, and exercise of shareholder voting rights,nor will it handle notarization of "guarantee power of attorney".
So Where Should I Go to Handle it?
You can use a power of attorney to handle Notary Public notarization and Singapore Academy of Law's dual authentication (Authentication&Legalization), and entrust others to handle it in China.
If it is necessary to notarize a declaration used in China, such as a "same person declaration" or a "waiver of inheritance declaration", a similar process can also be followed.
What is the Process?
1. The client drafts a power of attorney/statement (which can be filled out using the template provided by the Chinese agent/lawyer/document recipient), and after completion, please contact the Chinese agent/lawyer/document recipient to confirm whether the document is recognized by the domestic document using department in China. The power of attorney/statement can be written in Chinese.
**Due to the differences in laws and regulations between Singapore and China, Singaporean lawyers cannot guarantee the appropriateness of the content. The notarized content is to prove that the signature on the document is the true signature of the principal/declarant.
2. After making the payment, please send us the electronic draft of the power of attorney/declaration (please leave blank spaces for the signature and date of the principal/declarant). We will arrange for you to witness the signing and inform you of the completion time of the notarized document. Afterwards, the notary lawyer will issue the notarized document. After the notarization certificate is completed, we will assist you in obtaining the Singapore Academy of Law's Authentication&Legalization.
